MADISON, Wis. — The Wisconsin Department of Transportation collects millions of dollars each year by selling driver’s information through the DMV.

This is legal under Wisconsin law,but consumers still have limited protection federally through the Drivers Privacy Protection Act (DPPA).  

The Electronic Privacy Information Center states that “The DPPA prohibits the release or use by any State DMV of personal information about an individual obtained by the department in connection with a motor vehicle record.” 

But there are exceptions for permissible uses, including by any government agency. DHS reports that information sharing allows simple data to be exchanged through departments. 

Wisconsin does not have legislative restraints for the DMV from providing personal information upon request to DHS officials. Therefore leading to info-sharing, available at the simple request of ICE. 

Our Call For Action team is reminding consumers that in Wisconsin the DMV allows you to opt-out of information sharing.

You can remove your name and address from requests of 10 or more records by completing the MV3592 form and mailing it in to the DOT in Madison.

The option to opt-out is originally asked when applying for a license. You may have not noticed the additional check box near the ‘organ donor’ check box.

There is another box you can check that reads: Opt out: Do you wish to have your name withheld from lists DOT sells?
